Fresh@Work BV handles European order fulfillment, customer support, returns, and all communications with customers and regulators across the EU and UK.

Lio and the breathelio.com Site are operated by Van Lier Group FZCO, the parent company of record. For all day-to-day matters — orders, returns, support, and any legal or consumer inquiries within the EU, UK, or EEA — please contact our European representative above.

2.1 What Lio is

Lio is a flavored-air aromatherapy mouth diffuser designed as a behavioral habit replacement tool. It provides a hand-to-mouth ritual paired with natural, food-grade flavored air to help users break or replace everyday habits that involve repetitive mouth or hand movements.

Lio is intended as a universal habit replacement tool. Individual experiences may vary.

2.2 What Lio is not

Statements made on this Site, in our marketing, or on social media have not been evaluated by any medical or regulatory authority as therapeutic claims. Lio products should not be used as a substitute for professional medical advice, diagnosis, or treatment.

2.3 Safe use

By purchasing or using Lio products, you acknowledge and agree that you do so at your own discretion and risk. You further agree to:

• Read and follow all product instructions, ingredient lists, and safety information before use.
• Review the ingredients in each Lio Core before use to confirm suitability.
• Discontinue use immediately and consult a qualified healthcare professional if you experience any adverse reaction — including nausea, dizziness, headache, throat irritation, or allergic symptoms.
• Consult a qualified healthcare professional before use if you have a pre-existing medical condition, are pregnant, nursing, taking medication, or have known sensitivities to essential oils or food-grade flavorings.
• Not discontinue any prescribed medication or medical treatment on the basis of using Lio without the guidance of your healthcare provider.
• Use Lio products only as directed.
• Keep Lio products, Cores, and accessories out of reach of children and pets.

Lio assumes no responsibility or liability for any adverse reactions, health outcomes, or consequences resulting from the use, misuse, or reliance on Lio products.

2.4 Age restriction

Lio products are intended for adults. By purchasing or using Lio products, you confirm that you are at least the age of majority in your country or jurisdiction of residence, or that you have the consent of a parent or legal guardian.

These Terms apply to all offers, orders, agreements, and services made through breathelio.com. By placing an order or using the Site, you agree to these Terms in full.

We reserve the right to refuse service, terminate accounts, cancel orders, or modify content at our sole discretion.

We make every reasonable effort to display our products, ingredients, and packaging accurately. However, we cannot guarantee that product descriptions, photography, flavor representations, colors, or other content are entirely free of errors.

We reserve the right, without prior notice, to:

• Modify or discontinue any product, Core flavor, or SKU.
• Update formulations, ingredients, packaging, or designs.
• Limit quantities of any product sold per customer or per order.
• Correct typographical, pricing, or descriptive errors, including after an order has been placed.

Product availability may vary by market, and not all products are offered in all regions.

All prices are displayed on the Site in the applicable local currency and, where required by law, include VAT or equivalent sales tax. Shipping costs, duties, and additional taxes (where applicable) are calculated and displayed at checkout.

We reserve the right to change prices, promotions, and discounts at any time without prior notice. The price applicable to your order is the price displayed at the time your order is confirmed.

In the event of a pricing error, we reserve the right to cancel any affected order and refund any amounts already charged.

6.1 Order acceptance

Your order constitutes an offer to purchase. An order is only accepted once we send you a confirmation email. We reserve the right to refuse, cancel, or limit any order at our sole discretion, including but not limited to cases involving:

• Suspected fraud or unauthorized payment.
• Orders that appear to be for resale rather than personal use.
• Shipping addresses outside our serviceable regions.
• Inaccurate, incomplete, or suspicious order information.
• Violations of these Terms.

6.2 Your responsibilities

You are responsible for providing accurate, current, and complete information when placing an order — including your name, shipping address, email address, and payment details. Lio is not liable for delivery failures or delays caused by inaccurate information provided at checkout.

Payment is due in full at the time of purchase. We accept the payment methods displayed at checkout, which may include:

• Credit and debit cards — Visa, Mastercard, American Express.
• PayPal.
• Apple Pay and Google Pay.
• Klarna, iDEAL, Bancontact, and other locally available payment methods.

All payments are processed through secure, PCI-DSS compliant third-party payment providers. Lio does not store your full payment card details on its own servers.

If a payment is declined or reversed after the order has shipped, you remain liable for the full order value.

Shipping and delivery are governed by our Shipping Policy.

Estimated delivery times provided on the Site or in order confirmations are approximations only and are not guaranteed. Lio is not liable for delays caused by carriers, customs authorities, weather, or other circumstances beyond our reasonable control.

Risk of loss and title for products pass to you upon delivery to the address you provided at checkout.

Returns, refunds, order cancellations, and our satisfaction guarantee (where offered) are governed by our Refund & Return Policy. Please review this policy before placing an order.

EU and UK customers retain their statutory rights under applicable consumer protection laws, including the right of withdrawal, where applicable.

By signing up for the Refill Club subscription ("Subscription"), you agree to the following additional terms.

10.1 Subscription service

The Refill Club is a recurring subscription that delivers Lio Cores, accessories, and/or devices to you on a scheduled basis, at a discounted subscriber price. Subscription benefits, pricing, and included products may vary by region and are displayed at the time of sign-up.

10.2 Automatic renewal

Your Subscription automatically renews on your selected delivery frequency (e.g., every 30, 60, or 90 days) unless modified, paused, or cancelled by you prior to the next renewal date.

By providing your payment details, you authorize Lio to automatically charge your chosen payment method the applicable Subscription fee on each renewal date until cancellation.

10.3 Subscription fee & changes

The applicable Subscription fee is shown at checkout. Subscription fees may vary by region and may change over time. We will notify active subscribers by email of any price increase at least 14 days before it takes effect. Continued participation after the effective date constitutes acceptance of the new price.

Subscription fees are exclusive of applicable taxes where required by law. Taxes are calculated and applied at the time each order is processed.

10.4 Failed payments

If a Subscription payment fails, we will attempt to reprocess the payment up to five (5) times over a reasonable period. You will be notified by email of any failed attempts. If payment cannot be collected, we reserve the right to pause or cancel your Subscription.

10.5 Managing your subscription

You may manage your Subscription at any time through your customer account, including:

• Pausing, skipping, or delaying a shipment.
• Swapping Core flavors or adjusting product selections.
• Changing delivery frequency.
• Updating payment or shipping details.
• Cancelling your Subscription.

10.6 Cancellation

You may cancel your Subscription at any time, for any reason, through your customer account or by contacting support@breathelio.com.

Cancellation requests received after the cutoff time may not prevent the next scheduled order from processing and shipping. In such cases, the cancellation will take effect for the following billing cycle.

A Subscription is not considered cancelled until you receive an email confirmation of cancellation from us. It is your responsibility to retain this confirmation.

Cancelling a Subscription does not automatically cancel any already-processed orders. Order cancellations are governed by our Refund & Return Policy.

10.7 Our rights

We reserve the right to refuse, pause, or cancel any Subscription at our sole discretion, including for suspected fraud, abuse of promotions, chargebacks, or violation of these Terms.

Lio products are intended for personal, non-commercial use only. You agree to:

• Use Lio products only as directed.
• Not resell, redistribute, or commercially exploit Lio products without our written authorization.
• Not tamper with, modify, disassemble, or reverse-engineer Lio devices or Cores.
• Not use Lio products in any manner that could cause harm to yourself or others.

Lio is not liable for injury, damage, or adverse outcomes arising from misuse, unauthorized modification, or use of Lio products contrary to their intended purpose.

All content on this Site — including but not limited to the Lio name, logos, trademarks, product names, product designs, packaging, text, graphics, photography, video, audio, and software — is the property of Van Lier Group FZCO or its licensors, and is protected under applicable trademark, copyright, and intellectual property laws.

You may not reproduce, distribute, modify, publicly display, or create derivative works from any Lio content without our prior written consent. Unauthorized use may result in legal action.

Any feedback, suggestions, or ideas you submit to us regarding Lio products or the Site become the property of Lio and may be used without compensation or attribution.

If you submit reviews, photos, videos, comments, or other content to the Site or to Lio on social media, you grant Lio a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display that content in any media.

You represent and warrant that any content you submit is your own, does not violate the rights of any third party, and is not false, misleading, defamatory, obscene, or unlawful.

We reserve the right to remove any user content at our sole discretion.

To the maximum extent permitted by applicable law:

• Lio, its officers, directors, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages — including loss of profits, loss of data, loss of goodwill, or personal injury — arising out of or in connection with your use of the Site or Lio products.
• Lio's total aggregate liability for any claim arising out of or relating to these Terms, the Site, or any Lio product shall not exceed the amount you paid for the specific product giving rise to the claim in the twelve (12) months preceding the event.
• Nothing in these Terms excludes or limits any liability that cannot be lawfully excluded or limited under applicable consumer protection laws, including the laws of the European Union, the United Kingdom, and member states thereof.

You agree to indemnify, defend, and hold harmless Lio, Van Lier Group FZCO, and their respective officers, directors, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• Your misuse of Lio products.
• Your violation of these Terms.
• Your violation of any applicable law or the rights of any third party.

Lio is not liable for any failure or delay in performance caused by events beyond our reasonable control, including:

• Natural disasters, extreme weather, earthquakes, or floods.
• War, terrorism, civil unrest, or acts of government.
• Pandemics, epidemics, or public health emergencies.
• Strikes, labor disputes, or work stoppages.
• Supply chain disruptions, shortages of raw materials, or shipping carrier failures.
• Power outages, internet outages, or failures of third-party infrastructure.

The Site may contain links to third-party websites, services, or resources (e.g., payment processors, review platforms, social media). Lio is not responsible for the content, privacy practices, or conduct of any third party. Your use of third-party services is at your own risk and governed by the applicable third-party terms.

Your use of the Site and our handling of your personal data is governed by our Privacy Policy. By using the Site, you consent to the collection and use of your data in accordance with that policy.

Consumers resident in the European Union, the United Kingdom, or the European Economic Area retain the full benefit of all mandatory consumer protection laws of their country of residence. Nothing in these Terms is intended to override, limit, or waive those protections.

For matters not governed by mandatory local consumer law, these Terms are construed in accordance with the laws of the jurisdiction in which Van Lier Group FZCO, the operator of record, is registered. Any dispute that cannot be resolved directly with our European representative may be escalated through the applicable courts.

EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr to file a complaint.

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms to any affiliate or successor entity without notice.

These Terms, together with our Privacy Policy, Shipping Policy, Refund & Return Policy, and any other policies or agreements referenced on the Site, constitute the entire agreement between you and Lio regarding the Site and Lio products, superseding any prior agreements.

We reserve the right to update or modify these Terms at any time, at our sole discretion. Updated Terms take effect immediately upon publication on the Site. Your continued use of the Site or purchase of Lio products after any changes constitutes acceptance of the updated Terms.
